1. "The Contest"
The Newfoundland Quarterly Foundation, (hereinafter referred to as the "Contest Sponsor") is pleased to announce an opportunity for anyone subscribing, renewing or purchasing a gift subscription to the Newfoundland Quarterly during the "Contest Period" indicated below.
2. "The Prize"
One framed Jean Claude Roy original oil painting, entitled "Barr'd Harbour" (2008, 20" x 24").
The Prize must be accepted as awarded. Any shipping costs involved are the responsibility of the winner. Contest Sponsor reserves the right to substitute the Prize in whole or in part in the event that all or any components of the Prize are unavailable.
3. ELIGIBILITY:
(1) To be eligible for this Contest, the individual must purchase a new or renewal subscription or purchase a gift subscription to the Newfoundland Quarterly, and said subscription or gift subscription must be received by the office of the Newfoundland Quarterly during the "Contest Period".
(2) Entries are to be addressed to The Newfoundland Quarterly, Spencer Hall, Memorial University of Newfoundland and Labrador, 220 Prince Phillip Drive, St. John's, Newfoundland, A1B 3X5 (hereinafter referred to as the "NQ Office")
(3) The "Contest Period" is defined as commencing 12:01 AM NDT, April 1, 2009 and ending 11:59 PM NST March 31, 2010.
Board members of the Newfoundland Quarterly Foundation are ineligible to enter.
Entry materials/data that have been tampered with or altered are void.
4. HOW TO ENTER:
There are four ways to enter a subscription or gift subscription:
1. By mail: Complete and submit a subscription card, including submission of applicable payment to the Office of the Newfoundland Quarterly between 12:01 AM Newfoundland Daylight Time (NDT) April 1, 2009 and 11:59 p.m. NST March 31, 2010 (hereinafter referred as the "Contest Period").
2. By telephone: Individuals may call (709) 737-2426 and subscribe, including providing payment information.
3. By Fax: Individuals may fax subscriptions, including payment information to (709) 737-4330.
4. By e-mail: e-mail applicable subscription information, including payment information to: nfqsub@mun.ca
Individual's names will be entered once per subscription received. For example, if an individual purchases ten (10) gift subscriptions, his/her name will be entered ten (10) times into the draw.
5. DETERMINING THE WINNER
In April 2010, a random draw will take place in St. John's, Newfoundland and Labrador, Canada from all eligible entries during the Contest Period. The first entry drawn will be deemed the winner.
The odds of winning the Grand Prize will depend upon the total number of eligible entries received during the Contest Period. The Contest Sponsor will attempt to contact the potential winner via his or her address and or telephone number within two (2) business days after the draw.
In the event that the potential winner is not eligible, cannot be contacted by the Contest Sponsor within seven (7) business days following the draw, or does not sign and return the release within the specified time, Contest Sponsor shall have the right to disqualify that potential winner and to draw an alternative potential winner and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner shall be applied, with the necessary amendments, until a qualified winner has been duly selected.
6. CLAIMING THE PRIZE
Proof of identification must be provided upon request. In order to be declared a winner, the potential winner will be required to sign a declaration and release form stating that he/she has read, understood and complied with these official contest rules (as referenced in the following section below).
7. AUTHORIZATION, RELEASE & DISCHARGE
All Contest Entrants must agree to the following, and the Contest Winner must sign a document confirming:
That I have read and understood the Contest Rules.
That the Contest Sponsor is hereby authorized to broadcast, publish and/or disseminate my name, address, photograph, likeness and voice in connection with any promotion or publicity and/or general news, entertainment and information purposes at no additional compensation to me beyond the prize, which I agree to accept on the conditions set out in the Contest Rules and herein.
That I accept the prize as offered, knowing that the Contest Sponsor accepts no liability for anything associated with my entry in the Contest or my receipt or use of the prize. I hereby release and discharge the Contest Sponsor and its agents, servants and employees from any liability whatsoever associated with my participation in the contest and receipt or use of the prize.
8. ACCEPTANCE OF TERMS AND CONDITIONS
By entering this contest the entrants and participants automatically agree to accept and abide by these contest rules. All decisions of the Contest Sponsor with respect to any aspect of this contest, including without limitation the eligibility of entries, is final and binding on all entrants in all matters as they relate to this contest. All entries become the property of Contest Sponsor who assumes no responsibility for garbled, inaudible, lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions.
The Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof.
9. CONTEST SPONSOR RIGHTS
If for any reason, in the opinion of the Contest Sponsor, in its sole discretion, the contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond its control, the Contest Sponsor reserves its right to cancel, terminate, modify, amend or suspend the contest including cancelling any method of entry, and select a winner from previously received eligible entries.
The Contest Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or to be acting in violation of these rules or otherwise in a disruptive manner. The Contest Sponsor reserves its right to modify the rules of this contest without materially affecting the terms and conditions of the contest. The Contest Sponsor in its sole discretion, further reserves its right to terminate the on-line contest at any time during the Contest Period.
Any attempts to deliberately damage or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Contest Sponsor reserves its right to seek remedies and damages to the fullest extent of the law, including criminal prosecution.
10. LAWS & REGULATIONS
The contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this contest, each entrant consents to the collection, use and distribution of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsor for the purposes of implementing, administering and fulfilling this contest. The Contest Sponsor will not sell or transmit this information to third parties except for the purposes of administering the Contest.
